The civil society of Jammu and Kashmir submitted a resolution today, demanding the return of the body of Mohammad Afzal Guru, to the Prime Minister of India, Home Minister of India, Chief Minister of Jammu and Kashmir and the Speaker of the Lok Sabha.
Guru was convicted by the courts for attacking the Indian parliament in 2001 and was hanged on February 9, 2013 in Tihar jail, Delhi. The resolution has been endorsed by 850 civil society members and urges to consider the demand of the people of Jammu and Kashmir to return Guru?s body, which was buried in the jail, without any further delay.
In the resolution, submitted by prominent human rights activist, Khurram Parvez, on behalf of civil society of the state, it says that the people of state believe Guru was denied a fair trial, the opportunity to contest the rejection of his mercy petition, and an opportunity to meet his family before his secret execution.
The resolution calls it a grave human rights violation. ?India considers his dead body as seditious and the body has been subjected to continued ?imprisonment?. The way Mohammad Afzal Guru?s rights in the matter of the fate of his body and final burial have been denied represents a serious violation of human rights and a gross disregard of the sentiments of the people of Jammu and Kashmir,? the resolution adds.
It also says that the Indian State has no legal or moral right over the body of Mohammad Afzal Guru and it must be returned immediately to his family.
It cautions that the denial of the return of his dead body only strengthens the understanding of the people of the state that the Indian State continues to disregard the civil and political rights of the people in its ongoing belligerent policy for the control of territory.
It calls upon, on behalf of all the undersigned civil society members, the Government of India to end its policy of denial of civil and political rights of the people of Jammu and Kashmir and demands that the body of Mohammad Afzal Guru be returned immediately and unconditionally.
Guru?s family, mainstream and pro-freedom politicians have been demanding the return of his body. The leader of the opposition party, Mufti Mohammad Syed also wrote a letter to the Prime Minister, demanding the return of the body. So far there has been no positive response from the Indian government.
