Bank of America prepared to put Countrywide in bankruptcy court ...

Bank of America has a lot on the line in its trial over the hyper-controversial $8.5 billion settlement it struck with a group of bondholders to settle claims covering up to $424 billion worth of bonds. If a separate group of bondholders, led by AIG, succeed in breaking up the deal, the costs of settlement will skyrocket. Some think the total tab could hit $30 billion.

The proceedings have been quite interesting so far, as lawyers for the group of bond holders that struck the $8.5 billion deal, led by Pimco and BlackRock, aim to show that they got the best deal they could. During the negotiations, when lawyers tried to extract more from Bank of America, a lawyer threw documents back across the table at them. At another point, according to the Financial Times, a Bank of America-hired lawyer said that "our grandchildren will have grandchildren" before the bondholders saw a dime in settlement.

Perhaps the most interesting revelation was that Bank of America was threatening to put Countrywide into bankruptcy court if they could not get the deal they wanted, a situation that would be far worse deal for bondholders. Indeed, the bank said they had gone to the OCC to obtain the necessary permissions. There were lots of rumors about this at the time.

As of now, it's too early to say which side has the upper hand.

Airbus Bag2Go smart luggage can check itself in, skip baggage claim video

Many of us avoid flying with checked baggage when possible, and for good reason: even a simple delay can sour a whole trip. Airbus' new Bag2Go prototype could save us from having to pack light, however. The smart luggage carries a raft of sensors that work with an iOS app to bypass the usual airport drudgery. Its RFID chip lets travelers check in their bag and link it to every step of their itinerary; in theory, couriers can ship baggage to the hotel at a lower cost than usual. Bag2Go should also provide some reassurance through GPS tracking and alerts to any possible tampering. Airbus is still early into development, but it foresees a business model where customers can either buy a Bag2Go suitcase at a premium or rent one for a long vacation. As for us? We'll just be happy if our luggage avoids an unexpected detour to Belize.

Obama pressed Chinese leader on cybersecurity

RANCHO MIRAGE, Calif. (AP) ? President Barack Obama used an unusually lengthy and informal desert summit to present Chinese President Xi Jinping with detailed evidence of intellectual property theft emanating from his country, as a top U.S. official declared Saturday that cybersecurity is now at the "center of the relationship" between the world's largest economies.

While there were few clear policy breakthroughs on cybersecurity, U.S. officials said Obama and Xi were in broad agreement over the need for North Korea to be denuclearized. And both countries expressed optimism that the closer personal ties forged between the two leaders during the California summit could stem the mistrust between the world powers.

Still, Obama's national security adviser Tom Donilon said resolving cybersecurity issues would be "key to the future" of the relationship.

Obama told Xi that "if it's not addressed, if it continues to be this direct theft of United States property, that this was going to be very difficult problem in the economic relationship and was going to be an inhibitor to the relationship really reaching its full potential," Donilon said during a briefing with reporters following the summit.

In their own recap of the meetings, Chinese officials said Xi opposed all forms of cyberspying, but claimed no responsibility for attacks against the U.S.

"Cybersecurity should not become the root cause of mutual suspicion and frictions between our two countries. Rather, it should be a new bright spot in our cooperation," said Yang Jiechi, Xi's senior foreign policy adviser.

Yang said the two leaders "blazed a new trail" away from the two nations' past differences and "talked about cooperation and did not shy away from differences."

Obama and Xi met for about eight hours over the course of two days at the sweeping Sunnylands estate, marking a significant and unusual investment of time for both presidents. Their talks included a working dinner of lobster tamales, Porterhouse steak and cherry pie prepared by celebrity chef Bobby Flay, and a morning walk through the manicured gardens of the 200-acre estate on the edge of the Mojave Desert.

During their walk, the leaders stopped to sit on a custom-designed park bench made of California redwood that Obama presented to Xi as a gift.

The U.S. president told reporters that the talks were "terrific" as he and Xi walked side by side, both having ditched jackets and ties in a nod to the summit's informal atmosphere. The leaders closed the summit in low-key style, with no formal statements to the press, just a private tea with Xi's wife.

Obama and Xi did take a significant step toward tackling climate change, announcing that their countries had agreed for the first time to partner on reducing hydrofluorocarbons, a potent greenhouse gas used in refrigerators, air conditioners, and industrial applications.

The discussions on North Korea also proved promising, Donilon said, with the leaders agreeing that North Korea has to be denuclearized and that neither country will accept the North as a nuclear-armed state. North Korea is estimated to have a handful of crude nuclear devices, with some analysts putting its arsenal at four to eight plutonium bombs.

While China is Pyongyang's strongest ally and economic benefactor, Xi has signaled a growing impatience with North Korea's unpredictable and provocative nuclear threats.

"China has taken a number of steps in recent months to send a clear message to North Korea, including though enhanced enforcement of sanctions and through public statements by the senior leadership in China," Donilon said.

U.S. officials are hoping that Xi, who took office in March, proves to be a new brand of Chinese leader. He has deeper ties to the U.S. than his predecessors, given that he lived in Iowa briefly as a visiting official and sent his daughter to college in the U.S.

The two leaders appear to have more in common than Obama had with former Chinese leader Hu Jintao, who often appeared stiff and formal in meetings. Both men are in their 50s and share a love of sports: swimming and soccer on Xi's side, basketball and golf on Obama's. Both are also married to glamorous, high-profile wives who have played a strong role in shaping their images.

While Xi's wife accompanied him to California, Michelle Obama stayed in Washington. The White House said late Saturday that she wrote Xi's wife a letter welcoming her to the United States and expressing regret for not seeing her this weekend.

Xi also appeared to relish in the more informal talks. An Obama administration official said he discussed at length growing up in the Chinese countryside during his country's cultural revolution and how the experience impacted his perspective on China's development. Xi also broke out a bottle of "Maotai," a famous Chinese liquor, to toast Obama during Friday's working dinner, according to the official, who insisted on anonymity in order to discuss the private meetings.

The two leaders will likely meet again in September, on the sidelines of an international economic summit in Russia. Xi also invited Obama to travel to China soon for a similarly informal round of one-on-one talks.

For Obama, the China summit marked the start of a heavy foreign policy-focused stretch that includes trips later this month to Europe and Africa. But domestic controversies are competing for his attention, including revelations that the National Security Agency has been secretly collecting massive amounts of data from U.S. phone and Internet companies.

The president sought to distinguish between the NSA actions and China's alleged cyber intrusions, saying the two issues were separate and distinct. During a news conference with Xi on Friday night, Obama said he welcomed a debate on those differences.

During the question-and-answer session with reporters, Obama and Xi carefully avoided directly accusing each other's nations of high-tech intrusions, though they acknowledged an urgent need to find a common approach on addressing the matter.

Obama said rapid cyber advances meant the two countries were in "uncharted waters."

"We don't have the kind of protocols that have governed military issues and arms issues, where nations have a lot of experience in trying to negotiate what's acceptable and what's not," Obama said.

Xi, who called rapid technological advancements a "double-edged sword," claimed no responsibility for China's alleged cyberespionage. He said China was also a victim of cyberspying but did not assign any blame.

While Xi departed California Saturday afternoon, Obama planned to stay in California through the weekend, though he had no public events planned.

Sandra Bullock and Melissa McCarthy may have never met prior to filming their upcoming buddy-cop film "The Heat," but when the two started working together, they discovered they had a lot in common -- including working-mom guilt.

As they told Parade magazine in an article that will publish this weekend, making movies while having young children at home (Bullock has a 3-year-old son; McCarthy has daughters aged 6 and 3) was hugely guilt-inducing.

"It plagues me," said McCarthy, who also stars on CBS's "Mike and Molly." "I feel intensely guilty for working. But I feel like it's a weird modern phenomenon that you always feel guilty for it."

Added Bullock, "I don't know if I feel like a bad mom, but at the end of the day I'm always plagued with, 'Did I do enough? Should I go in a different direction?' But I also know that my entire life revolves around (son) Louis."

Both expressed strong protective feelings about trying to keep their kids out of the limelight. Bullock acknowledged, "We're adults, and we're fair game. ... But I instinctively throw things over Louis's head. ... He doesn't like (paparazzi). He gives them the stink-eye and they're like, 'That's such an angry kid' but I look at them and say, 'Only when you guys are around.'"

McCarthy was more emphatic, saying kids should be off-limits for roving photographers. "Strangers shouldn't be allowed to take a picture of your child and sell it for profit," she said. "They think, 'We're putting out a product,' but you're putting out a child."

Still, these shared trials may have made for a stronger, more instant chemistry in "Heat." Noted Bullock, "Having kids connected us on a deeper level. And the things we're obsessed with outside of being a mom are the same, too -- construction and home renovation. ... We're kindred spirits in that world. If we had a beer den, with Barcaloungers -- but our version of that -- it'd be great!"

Lehman customers to receive full payout: trustee

NEW YORK (Reuters) - Institutional customers of Lehman Brothers' collapsed brokerage will receive full payouts on their claims, James Giddens, the trustee winding down the brokerage, said on Friday.

A settlement announced earlier this year between the brokerage, Lehman's defunct parent company and its European affiliate will provide for full payments for hedge funds, corporate affiliates, counterparties and other customers, Giddens said in a statement.

Retail customers have already been paid in full.

Doctor who OK'd 'Cuckoo's Nest' hospital use dies

GRANTS PASS, Ore. (AP) ? The psychiatrist who opened the Oregon State Hospital's doors to filming of the 1975 Academy Award-winning movie "One Flew Over the Cuckoo's Nest" has died.

Dr. Dean Brooks died May 30 at a retirement home in Salem at age 96, family members said. He had been in declining health for several weeks after a fall.

Brooks' daughter Dennie Brooks said Friday the film's producers were turned down by all the other mental hospitals they approached. But her father, who was the Salem hospital's superintendent, saw the value of the movie in starting a national discussion about mental health and the responsibility of institutions to do no harm.

She said Dean Brooks also thought being part of a movie would be fun for him and for patients. He ended up playing a small role in the film ? which was based on a 1962 Ken Kesey novel and starred Jack Nicholson ? and making sure patients were involved, too.

Allowing the movie inside the hospital was a big career risk, but Dean Brooks regularly took risks on behalf of the patients, going so far as to take them on mountain-climbing expeditions and teaching them to rappel down cliffs, said Greg Roberts, the Oregon State Hospital's current director.

At the urging of staff, he allowed patients to start wearing regular clothes rather than uniforms long before other state hospitals.

"He would wink at me and say he could do stuff then I could never get away with today," Roberts said. "In my opinion, Dean Brooks literally set the bar on how to be a great state hospital superintendent."

Kesey based the novel on his experiences working at a Veterans Administration hospital while a writing student at Stanford University. But the movie made the story forever part of the history of the Oregon State Hospital, which has since moved to another building.

In the film, the free-spirited Randall McMurphy fakes mental illness to get off a prison farm, only to be defeated by the overwhelming institutional power of the hospital and the domineering Nurse Ratched.

Dean Brooks played Dr. Spivey, a psychiatrist who initially acquiesces to Ratched's power but later is inspired by McMurphy to stand up for himself and the patients.

While the movie gave him a platform to speak out for patients, Brooks had a reputation as an innovator before the film was produced, his daughter said. She cited a patient outing he organized that included whitewater rafting and was featured in Life Magazine.

"He saw Ken Kesey's true message about our capacity and organization's capacity to do harm to one another," Dennie Brooks said. "If he hadn't known that, he would have gone right along with the administration at the time and said, 'No, we're not gonna do it (the film).'"

Before giving his approval for the movie, Dean Brooks went to every ward and discussed the idea with patients and staff.

"To make the deal, he insisted primarily that the patients be respected, and the patients actually be involved," said Charles Kifleyak, who made a documentary about the psychiatrist and the filming of "Cuckoo's Nest" called "Completely Cuckoo."

"He felt the film had to benefit the patients in some way, or he was not going to do it," Kifleyak said from Burbank, Calif.

Nearly 90 patients ultimately had parts in the movie, or jobs behind the scenes, said Dennie Brooks, who also worked on the film as a location coordinator.

Though Kesey was unhappy enough with the movie's portrayal of his book to sue its producers, owners and distributors, he "got" Dean Brooks and what he was doing at the hospital, Brooks' daughter said. Kesey eventually won an undisclosed settlement.

The writer visited the hospital while working on a screenplay, which was rejected, and he later penned a handwritten note to Brooks.

"What I thought was the greatest innovation was the eye-level way you deal with the men and women under your care, and the affection that created affection," Kesey wrote.

After the movie, Dean Brooks remained friends with Kesey. They did speaking engagements and visited Disneyworld together, even sharing a hotel room, she said. Dean Brooks also remained friends with actress Louise Fletcher, who played Nurse Ratched.

Born July 22, 1916, in Colony, Kan., Dean Brooks put himself through medical school at the University of Kansas playing trombone in dance bands, his daughter said. There he met his wife, Ulista Jean Moser, a nursing student. She died in 2006 after 65 years of marriage.

Brooks went into the U.S. Navy in 1943 and served as a triage officer on ships taking part in the invasions of several islands in the South Pacific, including Iwo Jima, his daughter said.

After the war, while Dean Brooks served at a military hospital outside Medford, Ore., his commanding officer counseled him to become a psychiatrist.

Dean Brooks also worked at a Tacoma, Wash., VA hospital before joining the Oregon State Hospital staff in 1947 as a psychiatrist. He became superintendent in 1955.

After he retired in 1981, Dean Brooks moved to Everett, Wash., to be close to his grandchildren. He continued to advocate for the mentally ill, founding the Dorothea Dix Think Tank to decriminalize mental illness and find better ways of treating patients.

Besides Dennie Brooks, he is survived by two daughters, Ulista Jean Brooks and India Brooks Civey; a brother, Robert; five grandchildren; and two great-grandchildren.

Ontario Teachers to vote for SoftBank/Sprint deal

NEW YORK (Reuters) - The Ontario Teachers Pension Plan, the fifteenth biggest shareholder in Sprint Nextel Corp , said on Friday it intends to vote for SoftBank Corp's plan to buy 70 percent of Sprint for $20.1 billion.

The pension plan owned 40.2 million shares, or 1.33 percent, of Sprint, according to the latest publicly available information.

It did not provide details on its website on how it came to its decision ahead of a June 12 special meeting where shareholders are due to vote on the deal.

Several other shareholders have said, however, that they were not happy with the SoftBank deal after Dish Network made a rival $25.5 billion offer for Sprint on April 15.

Dish has been taking a closer look at Sprint's books for the last few weeks as it had said that its offer was subject to the completion of a due diligence process.

Hedge fund titan John Paulson, whose fund is the second biggest shareholder with 7.7 percent of Sprint according to public data, said in April that Dish's offer was compelling and offers more value to Sprint shareholders.

Omega Advisors, the ninth biggest Sprint shareholder with more than 2 percent of Sprint shares, has also said that Dish Chairman Charlie Ergen's offer was in the lead.

NKorea proposes working-level talks with SKorea

SEOUL, South Korea (AP) ? North Korea is proposing working-level meetings with rival South Korea in the North Korean border city of Kaesong on Sunday.

The statement issued by Pyongyang also said it would reopen on Friday a Red Cross communication line that the North shut down in March during high tensions with North Korean threats of war and South Korean counter-threats.

The two countries had agreed Thursday to hold talks on reopening a jointly run factory complex and possibly other issues. The South has proposed government-level talks be held Wednesday.

The easing tension comes ahead of a U.S.-China summit in which the North is expected to be a key topic.

Washington Post NSA, FBI tapping directly into servers of 9 leading internet companies

On the heels of yesterday's revelation that the NSA is bulk collecting call logs from Verizon Business customers, the Washington Post is reporting tonight on another initiative, code named PRISM. According to the report, it gives the FBI and NSA access to "audio, video, photographs, e-mails, documents and connection logs" from the central servers of Microsoft, Yahoo, Google, Facebook, PalTalk, AOL (parent company of Engadget), Skype, YouTube and Apple. Another program called BLARNEY sniffs up metadata as it streams past "choke points" on the internet, continuing the theme of bulk scooping of data most would think is private. The Post's knowledge of these programs comes from PowerPoint slides (like the one shown above) provided by a "career intelligence officer" driven to expose how deep it goes.

So what can the project see? Analysts based at Fort Meade use search terms to determine at least 51 percent confidence in a subject's "foreignness" before pulling data, which can include that of people found in a suspect's inbox. On Facebook, they can utilize the service's built in search and surveillance capabilities, monitor audio, video, chat and file transfers or access activity on Google's mail, storage, photo and search services. So... are you still logged in?

Update: We've contacted several of the companies listed, and so far have heard directly from Facebook and Google. Both companies statements are available in full after the break, where Google reiterated its stance that it does not have or provide "back door" access to anyone, while Facebook Chief Security Officer Joel Sullivan states "We do not provide any government organization with direct access to Facebook servers." Apple has made a similar statement to CNBC denying any knowledge of or participation in such a program.We will add any other response or updates as we receive them.

Update 2: Microsoft has also responded, similarly claiming that it only provides customer data under specific requests such as subpoenas, and if there is any broader program then it does not participate in it. Its full statement is after the break with the others.

CLEVELAND (Reuters) - More than $800,000 in donations has poured in from around the world to help the three women found a month ago, held captive for a decade in a Cleveland house, officials said on Thursday.

The case has resulted as well in raising awareness of the plight of missing persons, said Cleveland City Councilwoman Dona Brady.

"It takes a tragedy sometimes to make things happen," she said. "The police are taking missing persons much more seriously."

Cleveland police came under fire for not finding Gina DeJesus, Michelle Knight and Amanda Berry sooner.

On May 6, Berry, 27, was freed along with her 6-year-old daughter by neighbors from a house owned by Ariel Castro.

Berry had last been seen in 2003, and police say her child was fathered by Castro.

Cleveland police responded to Berry's 911 call and found DeJesus, 23, and Knight, 32, also in the house. Knight had disappeared in 2002 and DeJesus in 2004.

Castro, 52, is in jail on an $8 million bond and faces multiple charges of kidnapping and rape.

Brady and fellow council members Brian Cummins and Matt Zone set up the Cleveland Courage Fund, a tax-free trust for donations for the four victims.

So far, $825,000 has been collected from around the country and from various foreign countries.

The victims have started using money from the fund, said Chris Kelly, a co-trustee of the fund.

Concern also has prompted offers from doctors, dentists and people volunteering the use of vacation homes and cars, he said.

"The community is acting in a way you would hope they would act," Kelly said.

Kelly said the trust will be split equally four ways, as agreed upon by the three women.

The fund is designed to help them in all aspects of their lives, he said.

"Ten years out of society means not finishing school, no job training and not learning how to drive," he said.

There also is an attempt to get money for the victims from the state.

This week, State Rep. John Barnes Jr. of Cleveland introduced a bill that would award $25,000 a year, free medical care and state university tuition to any survivor of abduction held for eight years or more.

Cleveland police recently deployed a command bus to the city's crime-troubled east and west sides, with officers and FBI agents sent in to follow up tips and answer questions, according to spokeswoman Jennifer Ciaccia.

The house where the women were held is boarded up and surrounded by a 10-foot-high chain link fence.

Cummins, who represents the neighborhood, said residents have discussed having the house torn down and planting four oak trees for the child and three women who escaped.

Amazon introduces Storyteller tool to turn scripts into storyboards

Amazon Studios has been forging ahead with its push to develop original movies and TV series, and it has now introduced a new tool that it's hoping will help foster further development. Dubbed Amazon Storyteller, the tool lets writers quickly turn their script into a storyboard without the need for any actual artistic skills. As Amazon explains it, the tool first scans the writer's script and then "identifies the scenes, locations and characters from scene descriptions, and 'casts' them from a library of thousands of characters, props and backgrounds." Writers and filmmakers can then choose to customize the storyboard or upload some of their own images if they like, before sharing it with others to solicit feedback (naturally, it's only available if you submit your script to Amazon Studios). According to the company, the tool works best with contemporary dramas or romantic comedies given its current art assets, so you may still have your work cut out for you if you're looking to storyboard your post-apocalyptic fantasy epic.

BOSTON (AP) ? A future Hall of Famer who established his credentials in the open ice, there was Jaromir Jagr along the boards, mucking it up for a loose puck.

The 41-year-old former Pittsburgh great outdueled Evgeni Malkin for the puck and pushed it ahead to Brad Marchand, who brought it over the blue line and flipped it to Patrice Bergeron for the winning goal.

"Everyone is doing everything in order to get the success and to get the wins, and it doesn't matter what it is and who it is," Bergeron said early Thursday after his goal at 15:19 of the second overtime gave Boston a 2-1 victory over the Penguins and a 3-0 lead in the Eastern Conference finals.

"Jags is a perfect example. He's pretty much a legend; he's a guy that's going to be in the Hall of Fame at some point, and he's doing the little thing right there just to fight for the puck. And you notice that as a teammate, and it goes a long way."

After two blowouts in Pittsburgh to start the series, the Bruins returned to Boston to win a tightly contested game, getting a goal on their first shot just 1:42 in and then another on their last more than 93 minutes of playing time later.

With a victory in Game 4 at home Friday night, the 2010 Stanley Cup champions would earn a chance to play for a second title in three years.

"It was very long, very tiring. But we came out with the win," Marchand said. "We're obviously very happy, but we've still got a lot of work to do. They're going to come out harder the next game."

Tuukka Rask stopped 53 shots for the Bruins, and David Krejci scored Boston's only goal in regulation. With his assist, Jagr moved past Paul Coffey and into fifth place on the NHL's career list with 197 postseason points.

"He seems to be having a lot of fun with our group," Bruins coach Claude Julien said. "(He's) a 41-year-old that's never been known for real physical play, but more for the type of game that those Hall of Famers and superstar players play. And right now he's just doing whatever is asked of him, and that's a credit to Jags."

Tomas Vokoun made 38 saves for the Penguins a game after he was yanked from the net after giving up three quick goals in the first period. After Krejci, who leads the playoffs in scoring with nine goals and 12 assists, made it 1-0, Chris Kunitz tied it in the second period.

It was 1-1 after two periods, and it stayed that way through two more. But 4:41 before the second overtime would expire, Marchand grabbed the puck along the left-wing boards and centered it, where Bergeron redirected it past Vokoun.

That set off a celebration in Boston ? the first for the Bruins at home after they won the first two games of the series in Pittsburgh 3-0 and 6-1.

It is the first time all season that Pittsburgh has lost three consecutive games. The good news for the Penguins: The last of three teams to blow a 3-0 lead in an NHL playoff series was Boston, which lost four in a row to Philadelphia in the 2010 Eastern Conference semifinals.

"We threw it at them tonight and didn't get the win," Penguins coach Dan Bylsma said. "But it's a race to four and they are not there yet."

After two Boston blowouts, the Penguins matched the Bruins and even outshot them 39-25 in regulation ? including a third period in which Pittsburgh held a 14-4 advantage despite two Boston power plays. The Bruins didn't muster a shot in the final 7? minutes of regulation.

"I think the whole game we felt really comfortable with our play," said Penguins captain Sidney Crosby, who has yet to record a goal or assist in the series. "I think we felt like it was just a matter of time before we were going to get it. Unfortunately, they ... hung around and got one at the end."

The Bruins opened the scoring when Krejci circled around the net and took a slap shot that caromed in off Pittsburgh defenseman Matt Niskanen. But the Penguins tied it in the second ? the first time in the series, other than 0-0, that they have been even ? when Kunitz one-timed a pass from defenseman Paul Martin over Rask's right shoulder.

State Office of Insurance Commissioner Mike Kreidler delivered a mythbusting speech about the Affordable Care Act on Wednesday, telling a lunchtime audience that changes set to take place in health care in 2014 are much better than what the current health care system has to offer.

Kreidler?s audience on Wednesday were about 30 members of Tumwater Rotary, a gathering of business owners and guests who also had questions about the new health care plan, sometimes referred to as ?Obamacare.?

Kreidler wasted no time and addressed the myths from the start:

-Does the Affordable Care Act represent a federal government takeover of health care?

It does not, Kreidler said, because the Affordable Care Act is built on the existing private health insurance system. He also said that 78 percent of Americans aren?t going to see much of any change in their health care because they are already covered by Medicare or Medicaid, or are covered by their employer, either a large, self-insured or government employer.

-Are health care premium rates going to increase 70 percent in the individual health care market?

Based on health care insurance rate filings with the state, that is not the case, Kreidler said. He said rates are about the same, or lower, with enhanced benefit coverage.

?We?re not seeing the kind of rate shock that was talked about,? he said.

-If the status quo is working, why mess with health care?

It is not working, he said, particularly if you buy health insurance yourself or are a small employer, two groups beset with higher premiums and cuts to coverage.

?Double-digit increases have been the norm,? he said.

He also said that $1 billion a year is spent on uncompensated care in the state, either charity care or bad debt, and that about 1.1 million residents in the state don?t have health insurance. In Thurston County, $34 million a year is spent on uncompensated care and about 31,000 residents don?t have health insurance, he said.

?The system wasn?t sustainable,? Kreidler said.

In response to one audience member question, Kreidler said that those who can?t afford health insurance, even with financial assistance, are not required to have it and would be exempt from the penalty.

However, financial assistance will be available, for example, to a family of four earning up to $94,000 a year.

The penalty for those who don?t get health insurance starts at $95 per year, per individual in the first year, he said.

The Internal Revenue Service will handle that penalty, Kreidler said, either by deducting the amount from an income tax return or adding it to what is owed.

He thinks the penalty is too low and that some will pay that rather than insurance, but the penalty goes up over time, Kreidler said.

He acknowledged that the system isn?t perfect, but he said the Affordable Care Act is here to stay and likely will be changed over time, similar to changes that have been made to Social Security and Medicare over the years, he said.

?Americans deserve better and clearly better is what we?re going to be getting with the Affordable Care Act,? Kreidler said.

First came the Samsung Galaxy S4 "Google Edition." Then last week brought news of the HTC One "with Nexus user experience." In the past couple of days, rumors have been circulating that Sony will join the "Google Edition" club and release a vanilla Android phone of its own, with Romanian site AndroidGeeks breaking the story. Today we can confirm through our own sources that the Japanese manufacturer is indeed preparing a "Google Edition" of its flagship Xperia Z handset.

The "Google Edition" Sony Xperia Z will be sold in the U.S. through the Google Play Store later in the year, just like the two other Google Edition handsets. Being a "Nexus user experience" phone it’s very likely this new Xperia Z will benefit from speedier system updates, though we weren’t able to specifically confirm this point. (Nor could we nail down any details on possible international availability -- though we’re not holding our breath.)

Three-billion-year-old microfossils include plankton

June 6, 2013 ? Spindle-shaped inclusions in three-billion-year-old rocks are microfossils of plankton that probably inhabited the oceans around the globe during that time, according to an international team of researchers.

"It is surprising to have large, potentially complex fossils that far back," said Christopher H. House, professor of geosciences, Penn State, and lead author.

However, the researchers not only showed that these inclusions in the rocks were biological in origin, but also that they were likely planktonic autotrophs -- free-floating, tiny ocean organisms that produce energy from their environment.

The researchers looked at marine sediment rocks from the Farrel Quartzite in Western Australia. Isotopic analysis using secondary ion mass spectrometry was carried out at UCLA. "Ken (Kenichiro Sugitani, professor, Graduate School of Environmental Studies, Nagoya University, Japan, and a co-author) discovered these unusually shaped microfossils embedded in really old rock," said House.

To determine if these inclusions were actually biological in origin, the researchers looked at 15 different samples of Farrel Quartzite and determined their stable carbon isotope ratios. The percentage of carbon 13 in the microfossils was indicative of material produced by biological processes. They found that the carbon 13 percentage in the background organic matter in the surrounding rock was different from that of the microstructures.

"When considered along with published morphological and chemical studies, these results indicate that the Farrel Quartzite microstructures are bona fide microfossils, and support the interpretation that the spindles were planktonic," the researchers report in the current issue of Geology. The morphological and chemical studies were done by Sugitani and Dorothy Oehler, who is also a co-author and research scientist, Astromaterials Research and Exploration Science Directorate, NASA -- Johnson Space Center.

The spindle-shaped microfossils are from 20 to 60 microns in length, about the size of fine sand and within the size range of today's microplankton.

Stable carbon isotope analysis can determine the biological origin of these microfossils because they used carbon dioxide to create energy and incorporated the carbon into themselves. During this process, the organisms selectively incorporate more carbon 12 than carbon 13 from the available carbon, producing a signature of biological origin.

Oehler notes that the spindles appear to be the same as those found in rocks from the Strelly Pool Formation in Western Australia and the Onverwacht Group in South Africa and Swaziland that are both 3.4 billion years old.

"The existence of these microfossils in diverse locations as far back as 3.4 billion years ago suggests that the oceans probably had life in them for a very extended period of time," said Oehler. "Moreover, this has implications beyond what we have done here, suggesting the evolution of diverse life proceeded quickly."

Also working on this project was Koichi Mimura, Graduate School of Environmental Studies, Nagoya University, Japan.

Boehner says Obama should explain NSA program

WASHINGTON (AP) ? House Speaker John Boehner is calling on President Barack Obama to explain why the data-collecting tools used by the National Security Agency are necessary.

Boehner also won't say whether he was briefed or knew about the program.

Boehner responded to the publication of a top secret court order for telephone records of millions of U.S. customers of Verizon. The Ohiol Republican says he's confident that House and Senate intelligence committees are providing oversight of the NSA. But he says it's time for Obama to "outline the issues" and explain why such tools are critical. He says Congress will look at any policy and privacy concerns of citizens.

The Obama administration has defended the NSA's activities, calling them important and saying they were approved by all three branches of government.

Resistivity switch is window to role of magnetism in iron-based superconductors

June 5, 2013 ? Physicists at the U.S. Department of Energy's Ames Laboratory have discovered surprising changes in electrical resistivity in iron-based superconductors. The findings, reported in Nature Communications, offer further evidence that magnetism and superconductivity are closely related in this class of novel superconductors.

"We found that the directions of smallest and largest resistivity within the conducting layers are significantly dependent on the composition of the compounds, and in some compositions, they change sign, or, in other words, electric current flows easier in the direction that was originally more difficult" said Ames Laboratory faculty scientist Ruslan Prozorov. "This change can only be explained if the underlying magnetic behavior is intimately connected to superconductivity."

Understanding the basic physics behind iron-based superconductivity may someday make it possible to use them for super-efficient energy technologies.

Erick Blomberg, an Ames Laboratory graduate research assistant, spearheaded the research under the guidance of Prozorov and Ames Laboratory scientist Makariy Tanatar. The team studied resistivity in barium-iron-arsenide compounds with different chemical substitutions, which allowed for

probing electronic properties throughout the entire regime in which magnetism and superconductivity coexist.

In conventional superconductors, magnetism and superconductivity do not coexist and one suppresses another. In contrast, some iron-based superconductors show significant overlap between magnetism and superconductivity, which allows for unique measurements of their properties in the coexistence region.

"But there is a complication," said Prozorov, who is also an Iowa State University professor in the Department of Physics & Astronomy. "In the coexistence region, the crystal structure of barium-iron-arsenide crystals is such that the crystal splits into the structural domains (also known as structural twins), which makes studying directional electronic properties difficult.

To eliminate the structural domains, the team developed a technique in which single crystals are physically pulled apart. A sample is suspended by wires in a horseshoe-shaped bracket, which can be mechanically stretched. This assembly is then placed into a small liquid helium cryostat to reach temperatures where magnetism and superconductivity coexist. Polarized optical microscopy is used to distinguish between different structural domains to verify that the samples are in the detwinned (without fragmented domains) state. Electric resistivity is then measured.

Blomberg and colleagues studied a series of samples, covering a precise range of compositions, provided by Nanjing University's Hai-Hu Wen.

"In this case, making chemical substitutions was, in effect, taking electrons away from the compound or adding electrons to the compound," said Blomberg, who will soon receive a PhD in condensed matter physics from Iowa State University. "And as you take electrons away, at a certain point the direction in which it was harder for electricity to flow becomes the direction it was easier for it to flow."
